To define what is considered a commercial space so that other proposals can use the term uniformly.
Proposal
A space in this proposal is a land body, water body, air space, building, vehicle, or portion thereof.
A publicly owned space where products or services are bought or sold by the general public is a commercial space. Such a place does not lose its public space status, it gains an additional commercial space status.
A privately owned space where products or services are sold to the general public or where items are bought from the general public or where any other commercial or financial transactions occur is a commercial space.
A privately owned space where the benefit of commercial transactions are realized, or spaces where a person must pass in order to enter or exit a commercial space, is also a commercial space.
A privately owned space which is not a public commercial space and where employees or contractors work is a private commercial space.
A privately owned space which is not a public commercial space and where the benefits of employment are realized such as getting a paycheck is considered a private commercial space.
A privately owned space which is not a public commercial space and through which a person must pass in order to enter or exit a private commercial space, is considered a private commercial space.
A public commercial space which has posted hours of operation during which it is open to the public is considered a private commercial space outside of its posted hours of operation.
Discussion
A restaurant lobby and seating area is considered a commercial space because that’s where customers order, pay, and eat — buy the food and realize the benefit of that transaction.
A restaurant’s office and kitchen are also considered commercial spaces because the restaurant’s employees work there. However, these are private commercial spaces in contrast to the public seating and dining area which is a public commercial space.
