    Intent

    To define what is considered a public space so that other proposals can use the term uniformly.

    Proposal

    Public access means the ability of the general public to enter the space, with or without a fee.

    Land body means any land surface or interior (underground) of a planet, moon, asteroid, or any other significant accumulation of solid elements in space.

    A land body owned or operated or regulated by the government and which is not restricted from public access is considered a public space.

    Water body means the surface or interior (underwater) of any significant accumulation of water such as a pond, pool, lake, stream, river, canal, sea, or ocean.

    A water body owned or operated or regulated by the government and which is not restricted from public access is considered a public space.

    Air space means the portion of the atmosphere that is considered the troposphere where most water vapor exists and most weather occurs, and generally designated as being above specified land or water body or portion thereof.

    Air space above a public land body or public water body, and is regulated by the government, and which is not restricted from public access is considered a public space.

    Atmospheric space means the portion of the atmosphere above the troposphere.

    Atmospheric space regulated by the government and which is not restricted from public access is considered a public space.

    A building is a fixed structure located on a land body (surface or underground) or a water body (surface or underwater).

    A building, or portion of a building, which is owned or operated or regulated by the government and which is not restricted from public access is considered a public space.

    A vehicle, or portion of a vehicle, which is owned or operated by the government and which is not restricted from public access is considered a public space.

    Discussion

    A public park is considered a public space, whether or not there is a fee for entry, because it is not restricted from public access.

    A restriction from public access is a permanent thing, such as the office area of the post office, in contrast to the lobby of the post office.

    The passenger area of a city bus is a public space but the driver’s seat and driver’s area is a restricted government-owned space which is not a public space.
