    Intent

    To define what is a biological trait so that other proposals can use the term uniformly.

    Proposal

    Biological traits are physical traits that are passed from parents to offspring through genes.

    Biological traits include genetics, eye color, natural hair color, hair texture, baldness, skin color, freckles or lack of freckles, chin style, earlobes, dimples, height, finger length, sex, sexual orientation, and many more.

    Biological traits do not include age, weight, tattoos, scars, health, infection, injury, or cybernetics.

    Discussion

    A person’s age is not included as a biological trait because it changes every day we tend to have many age-based rules such as a child of a certain age must attend school, or someone must be a certain age to drive, or to vote, or to buy certain items, or to serve in the military, or to rent a car, or to be president, or to receive retirement benefits (prohibited from receiving them at an earlier age), and so on.

    A person’s weight is not included as a biological trait because the same person can gain or lose weight by varying their activities and we still consider them to be the same person.

    Tattoos are not considered biological traits because they are added to the body.

    Scars are not considered biological traits because they are the result of damage to the body.

    Abilities and disabilities are not considered biological traits because it is reasonable and common to regulate behavior based on abilities. For example, a person must be able to pass a driving test to get a license to drive, or a person must be able to refrain from making noise to stay in a movie theater and watch the movie. If they’re not able to stay quiet the theater can require them to exit the room. A person with a physical or mental disability due to a biological trait or medical condition or accident could potentially overcome it and if they do then any discrimination based on their biological traits that is unrelated to their abilities would be a violation of rights.

    Cybernetics are not considered biological traits because they are a result of intentional changes to the body and are not biological. Specifically the government may need to regulate cybernetics in the future as the practice expands.
