Intent
To limit the authority of the military over retired or discharged personnel.
Proposal
A retired or discharged enlisted or officer shall not be subject to the regulations or authority of the military for any reason.
Discussion
In some countries there is a practice of recalling retired enlisted or officers to the military to stand trial as a soldier for some offense allegedly committed after separation. This practice is unjust. Once a person leaves the military, they should not be under the authority of the military.
The two exceptions are recall for service as an advisor or trainer in a national security emergency or trial for war crimes that does not require a recall to service.
